The Justice Department is asking the Supreme Court to block the district court’s decision, some of which were upheld by the Fifth Circuit Court of Appeals, due to take effect Saturday. This would reimpose burdensome nationwide restrictions on mifepristone that the Food and Drug Administration has lifted in recent years.
Minutes earlier, the mifepristone maker had asked the Supreme Court for emergency relief, citing an “unprecedented order” from the Fifth Judicial Circuit that “created regulatory chaos across the country.”
