The company responsible for 7.5 billion robot calls to the south by nearly every attorney general

Published

on

We can all agree that robocalls are the worst. While there may never be a way to completely get rid of them (though the agencies are certainly working on it), one of the most prolific sources of these intrusions has finally come to justice.

CBS News reports that attorneys general from 48 states (plus the District of Columbia) are coming together to file a bipartisan lawsuit against Arizona-based Avid Telecom, its owner Michael D. Lansky, and Vice President Stacey S. Reeves. V 141 page suit claims that the company illegally made more than 7.5 billion calls to people on National Do Not Call Registry. Arizona Attorney General Chris Meyes claims that almost 197 million automated calls were made to phone numbers in her state in the five-year period from December 2018 to January 2023.

The lawsuit alleges that Avid Telecom spoofed phone numbers, including 8.4 million phone numbers that appeared to belong to the government or law enforcement, as well as other numbers disguised as those of Amazon, DirecTV and many others. The lawsuit alleges that Avid Telecom violated the Telecommunications and Consumer Protection Act, the Telemarketing Rule and a number of other telemarketing and consumer protection laws.

AG is asking the court to join Avid Telecom from making illegal calls by robots, as well as damages and restitution to people it called illegally. They also use several legal means to get Avid to cough up money for every infraction, which, given the sheer volume of calls made, can add up quickly. Sumco Panama, which accounted for comparatively less than 5 billion automated calls, was fined nearly $300 million by the FCC late last year.

Earlier this month was reported that the US Federal Trade Commission sued XCast Labs for allegedly helping other companies call those on the National Do Not Call Registry.

In 2017 Dish reached a settlement it cost them $210 million. The company allegedly made millions of calls trying to sell and promote its satellite TV service. Dish ultimately had to pay a civil penalty of $126 million to the US government and $84 million to residents of California, Illinois, North Carolina and Ohio. Hopefully we will see a similar result with Avid Telecom.
